Welcome to GitChunk. These Terms of Service (“Terms”, “Agreement”) govern your access to and use of the GitChunk software, API endpoints, web dashboards, CLI integration tools, local caching proxies, and associated services (collectively, the “Service” or “GitChunk”) provided by Quaint Studios LLC (“Company”, “we”, “us”, or “our”), a Florida limited liability company with an address at 5004 E Fowler Ave Ste. C #349, Tampa, FL 33617.
By registering an account, integrating GitChunk into your Git configuration or development pipeline, deploying our local proxy container, or otherwise using the Service, you (“Customer”, “User”, “you”, or “your”) agree to be bound by these Terms. If you are entering into this Agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms.
1. Description of the Service
GitChunk is a high-performance, specialized Git Large File Storage (LFS) hosting, routing, and optimization platform. GitChunk acts strictly as an external binary asset management backend that integrates with third-party Git version control systems (including, but not limited to, GitHub, GitLab, and Codeberg). GitChunk handles the routing, optimization, and storage of large file payloads via edge computing, but does not host or store your primary text-based Git source code repository history.
2. Account Security, Eligibility, and Roles
2.1 Eligibility and Age Requirements
You must be at least thirteen (13) years of age to create an account or use GitChunk. If you are under 13, you may not use the Service under any circumstances. If you are between 13 and the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian to use the Service.
2.2 Registration and Multi-Tenancy
To use the Service, you must create an account. You agree to provide accurate, complete, and current information. GitChunk supports multi-tenant organization workspaces, allowing administrators to provision access to developer seats, teams, and external contractors.
2.3 Credentials & API Key Security
Access to GitChunk’s endpoints is authenticated via secure tokens, federated Single Sign-On (SSO), and Personal Access Tokens (PATs). You are solely responsible for maintaining the absolute confidentiality of your passwords, API keys, and access tokens.
- You agree to restrict access credentials only to authorized personnel.
- You agree to notify us immediately at [email protected] of any unauthorized access, credential leaks, or security breaches.
- Quaint Studios LLC is not liable for any unauthorized access to, alteration of, or destruction of your assets resulting from your failure to protect your authentication keys.
3. Acceptable Use Policy (AUP) & Anti-CDN Abuse Shield
3.1 Software Development Restriction
GitChunk’s Large File Storage endpoints, API routes, and pre-signed URL generation tools are strictly optimized and licensed for software development version control workflows, automated CI/CD build environments, and administrative repository management.
3.2 Prohibited Use (The Anti-CDN Shield)
You are explicitly prohibited from utilizing GitChunk’s storage, edge routing infrastructure, or pre-signed download URLs as a high-volume, general-purpose Content Delivery Network (CDN) or media distribution server for live production environments. Prohibited uses include, but are not limited to:
- Streaming media, game patches, high-resolution textures, or assets directly to active, running game clients or mobile applications at runtime.
- Serving public file-sharing directories or asset distribution sites.
- Circumventing standard software development tooling boundaries to pipe egress traffic to non-developer endpoints.
3.3 Telemetry and Abuse Detection
To protect our zero-egress pricing model and platform stability, GitChunk utilizes edge-based analytical monitoring. We reserve the right to monitor download telemetry (including request volume, read-to-write ratios, and unique non-developer IP footprints).
- If your usage patterns indicate that GitChunk is being utilized as a runtime CDN, we reserve the right to immediately rate-limit, throttle, suspend, or terminate your associated repository endpoints without prior notice.
4. Shared-Hash Deduplication, Repository Forking & Intellectual Property
4.1 Ownership of Assets
Quaint Studios LLC claims absolutely no ownership, copyright, or intellectual property rights over any binary payloads, code, models, audio, textures, or files that you upload to the Service. Your assets remain entirely yours.
4.2 Deduplication License
GitChunk utilizes “Webhook Fork Optimization” to eliminate duplicate storage space across related repositories and forks. When you upload an asset, the Service generates a cryptographic hash (SHA256). If a repository is forked or an identical file is uploaded, our database maps references to the pre-existing storage block.
- By uploading assets to GitChunk, you grant Quaint Studios LLC a non-exclusive, worldwide, royalty-free, perpetual, fully-paid license solely to store, index, deduplicate, cache, and transmit the cryptographic hashes and raw bytes of your assets to fulfill the technical demands of the Git LFS protocol.
4.3 Retention of Deduplicated Assets
You acknowledge and agree that if you delete a branch, repository, or your entire account, the underlying physical files may persist on our storage layers (such as Cloudflare R2) if another active, authorized workspace or repository fork maintains a logical database reference to those exact SHA256 hashes.
4.4 Data Isolation & Access Controls
Quaint Studios LLC guarantees that the existence of globally deduplicated file hashes will never expose or leak your proprietary files across unauthorized accounts. Access to any physical asset remains strictly bound to the authenticated access control lists (ACL) of the remaining active, authorized workspaces. If another user uploads a file with an identical hash, they only gain access to their own logical instance and are never made aware of your repository structure or identity.
4.5 Absolute “No AI Training” Guarantee
Quaint Studios LLC legally covenants and warrants that none of your code, repository structure, binary payloads, textures, models, animations, audio, or other assets uploaded to GitChunk will ever be accessed, sold, licensed, or used to train, fine-tune, or benchmark artificial intelligence models, machine learning systems, or automated content-generation algorithms by us or any third-party subprocessor under our direction.
5. Garbage Collection & Data Loss Disclaimer
5.1 Automated Maintenance Schedules
To maintain optimized storage footprints, GitChunk runs automated garbage collection scripts on a periodic basis (typically weekly) via Cron routines. These scripts permanently delete unreferenced (“orphaned”) binary assets from our storage layer (such as those left behind by client-side force-pushes, deleted Git branches, or hard resets).
5.2 User Responsibility for Git Operations
You are solely responsible for executing client-side Git commands, including but not limited to force-pushes (git push --force), branch deletions, and repository rewrites.
5.3 Limitation of Liability for Orphaned Data Purges
You acknowledge that GitChunk is under no obligation to archive, retain, or recover any files that have lost their relational database metadata tracking due to your local Git actions. Quaint Studios LLC provides no warranty of recovery for assets purged during standard automated maintenance windows and shall have zero liability for any data loss, repository corruption, or production delays resulting from client-initiated Git commands.
6. Bring Your Own Storage (BYOS) Liability Boundary
6.1 Third-Party Cloud Infrastructures
Enterprise tiers may configure GitChunk’s Storage Adapter Pattern to route and sign payloads directly to their own self-managed cloud storage buckets (e.g., Amazon S3, Google Cloud Storage, or private MinIO instances).
6.2 Exclusion of Storage Costs & Billing Liability
Under a BYOS configuration, you are solely responsible for provisioning, managing, and paying for your third-party cloud infrastructure. Quaint Studios LLC is not responsible for, and shall have no liability regarding:
- Storage bills, API call charges, or egress taxes incurred on your third-party cloud accounts.
- Unexpected billing spikes caused by developer activity or network requests.
- Network downtime, server failures, or misconfigured storage bucket access policies on your cloud accounts.
6.3 Credential Security for BYOS
When configuring BYOS, you must provision minimally-scoped, time-limited credentials (such as AWS IAM keys). Quaint Studios LLC is not liable for security breaches, unauthorized data access, or resource leaks arising from your mismanagement of your cloud access keys.
7. On-Premises Local Cache Proxy License & Limitations
7.1 Container License Grant
Subject to your compliance with these Terms, Quaint Studios LLC grants you a limited, non-transferable, non-assignable, revocable, non-exclusive license to deploy and execute our dockerized Local Cache Proxy container solely on your internal private Local Area Networks (LAN) to optimize regional developer download speeds.
7.2 Zero Maintenance Obligation for Host Hardware
You are entirely responsible for provisioning, securing, configuring, and maintaining the underlying hardware, virtualization layers (e.g., Docker Engine), and network routing structures required to execute the Local Cache Proxy.
7.3 Discharge of Damages
Quaint Studios LLC shall not be held liable for any damages, security exploits, data breaches, internal office network downtime, packet routing loops, or local hardware failures that result from your deployment, configuration, or execution of the on-premises cache proxy container.
8. Security Scanning, Secret Detection, and Accuracy Disclaimers
8.1 Automated Payloads and Scans
To defend the platform’s global network and ensure security compliance, GitChunk programmatically scans file headers and metadata for malware, viruses, and accidentally exposed plaintext credentials (“secrets”).
8.2 Disclaimer of Scan Outcomes
You acknowledge that automated security scanning is provided on an “as-is” and “as-available” basis. Quaint Studios LLC does not warrant that:
- Automated security scans will be 100% accurate, error-free, or free from false positives.
- The scans will catch every malicious element or exposed credential (false negatives).
8.3 Blocked Payload Liability
In the event that a benign asset is flagged and blocked by our automated filters (a false positive), causing production or release delays, or in the event that malicious code passes through undetected (a false negative), Quaint Studios LLC shall not be held liable for any compromised local developer environments, security incidents, or financial damages incurred by you or your clients.
9. Fees, Billing, and Subscriptions
9.1 Merchant of Record
GitChunk partners with Lemon Squeezy as its Merchant of Record for billing, card processing, subscription management, and sales tax compliance. By subscribing to a paid GitChunk tier, you agree to comply with Lemon Squeezy’s terms and payment conditions.
9.2 Refunds
Due to the hard infrastructure costs incurred by Quaint Studios LLC upon the allocation of storage and transit resources, all purchases, subscriptions, and usage-based billing charges are non-refundable, except where explicitly required by applicable regional law. Any exceptions or manual refunds granted by support staff are made strictly on a one-time, discretionary, case-by-case basis and do not constitute a waiver of this policy.
9.3 Subscription Adjustments
Your storage quotas, seat limits, and features are determined by your chosen billing plan. Lemon Squeezy webhooks will automatically adjust your D1 database storage limits upon successful billing updates.
9.4 Delinquency and Suspension
If a payment fails or is disputed, we reserve the right to suspend your write/upload privileges to your LFS endpoints. If your account remains delinquent for more than thirty (30) days, we reserve the right to delete your metadata and permanently purge your associated R2 assets.
10. Service Level Agreements (SLAs) & High-Availability Limits
10.1 Inherited Edge Dependencies
GitChunk’s API, database, and object storage layers are built natively on top of Cloudflare’s serverless infrastructure (Workers, D1, R2, KV). You acknowledge that GitChunk inherits the performance and availability metrics of Cloudflare, Inc.
10.2 Outages and Force Majeure
Quaint Studios LLC is not liable for any service interruptions, packet drops, or API latency spikes caused by regional outages, DNS routing issues, or hardware failures originating from Cloudflare, AWS, or upstream cloud providers.
10.3 Cumulative SLA Cap on Financial Remedies
For enterprise workspaces with signed Service Level Agreements (SLAs), the maximum, sole, and cumulative financial remedy for any service outages, asset access failures, or breach of performance metrics shall be strictly capped at the total cash amount actually paid by you to Quaint Studios LLC during the immediate billing cycle in which the outage occurred. No punitive, speculative, or consequential damages are recoverable under any circumstances.
11. Disclaimer of Warranties
EXCEPT AS EXPLICITLY PROVIDED IN A WRITTEN ENTERPRISE SERVICE LEVEL AGREEMENT, THE SERVICE (INCLUDING THE WEB INTERFACE, CLOUDFLARE WORKERS, D1 DATABASE, R2 STORAGE ENGINES, AND LOCAL PROXY CONTAINERS) IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUAINT STUDIOS LLC EXPLICITLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, CHRONOLOGICALLY PERFECT, SECURE FROM ALL SECURITY VULNERABILITIES, OR FREE OF ERROR, OR THAT ANY LOSS OF ASSET DATA WILL BE PREVENTED.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUAINT STUDIOS LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF USE, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR INABILITY TO ACCESS OR USE THE SERVICE.
- ANY CONDUCT, DATA LOSS, OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.
- ANY COMPROMISE OF REPOSITION DATA DUE TO CLIENT-SIDE GIT FORCE-PUSHES.
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR PAYLOADS OR DATA, EVEN IF QUAINT STUDIOS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13. Indemnification
You agree to defend, indemnify, and hold harmless Quaint Studios LLC and its licensees, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:
- Your use of and access to the Service.
- Your violation of any term of this Agreement or your Acceptable Use Policy.
- Your violation of any third-party rights, including any copyright, proprietary, intellectual property, or privacy rights.
- Any claims that your uploaded binary payloads caused security breaches, malware infections, or operational damages to third-party environments.
14. Governing Law and Dispute Resolution
14.1 Governing Law
This Agreement and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the internal laws of the State of Florida, United States, without giving effect to any choice or conflict of law provision or rule.
14.2 Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Hillsborough County (Tampa), Florida before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures.
Exceptions to Arbitration: Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Service, or intellectual property infringement (for example, trademark, trade secret, copyright, or patent rights) without first engaging in arbitration. Additionally, either party may assert claims, if they qualify, in small claims court in Hillsborough County, Florida.
Class Action Waiver: THE PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THEIR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.
15. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least thirty (30) days’ notice prior to any new terms taking effect by posting an update in the SvelteKit developer dashboard or by sending an email to your registered workspace administrator. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.
